130 Environmental Park Permit Application Goes to TCEQ Commission for Final Approval

LOCKHART, TX – May 22, 2017 – On May 10, 2017, the Administrative Law Judges (ALJ’s) again rejected the opponent’s arguments related to the sufficiency of the permit application and reaffirmed their prior findings of fact and conclusions of law.  The ALJ’s continue to recommend that the permit be granted by the TCEQ Commissioners.

The release of the letter by the ALJ’s effectively ends this important step in the permitting process. The 130 Environmental Park Facility Application has been deemed technically complete by the TCEQ professional staff and, after an exhaustive hearing in front of independent judges, been recommended for approval.  The final step in the permitting process is action by the TCEQ Commissioners.   It is expected that the application will be on a Commission agenda this summer.

“It is also our hope that we can continue to work with Caldwell County on entering into a Host Agreement that will benefit the Community,” Green said. “We are grateful for the efforts of the leaders of the County Commissioners Court to initiate a process to discuss the Host Agreement and change the relationship with the County.”
